NOTICE OF DECISION

ZONING BOARD OF ADJUSTMENT TOWN OF ANDOVER, NEW HAMPSHIRE

You are hereby notified that the request of Stephen C. and Robert S. Anderson for a Special Exception at the property at 102A Currier Road, Tax Map 11 Lot 311,902 following the requirements of Section IX D. 2. of the Andover Zoning Ordinance to permit:

Construction of a single Detached Accessory Dwelling Unit (less than 1,000 square feet in size) Not Meeting the Criteria of Article XV: Section C of the Andover Zoning Ordinance

IS GRANTED WITH CONDITIONS

Conditions of this approval include the following:

Proposed accessory dwelling unit will be occupied by family members only;

The primary dwelling and accessory dwelling will share the same driveway access, the same street address, common wastewater disposal system, and the same potable water source; and

There will be no further subdivision through land or condominium subdivision

 

Reasons/facts supporting the granting of the Variance application by 3-1 vote of the members of the board:

The proposed use is compatible with other uses permitted and existing in the district in which the property is located.

The character, size, location, and design of the proposed use is in harmony with the district and adjacent properties. 

 Proposed use is consistent with proper develop of the community and its general welfare. 

The proposed use will not hinder or discourage the appropriate use and development of adjacent uses or impair values of adjacent properties.

The public health, morals, safety, and general welfare of the neighborhood and the town will not be impaired.

Denial of the special exception would unreasonably restrict the applicant without a material balancing benefit to the district in which the property is located.
